Chapter 7 Bankruptcy for Individuals and Small Businesses
Despite the hype, Chapter 7 bankruptcy is still available for most people and small businesses, even after the 2005 change in the bankruptcy laws. Chapter 7 bankruptcy is available to consumers and businesses. Widely known as "liquidation bankruptcy," its purpose is debt elimination. Even if you might fail the Means Test as an individual, the Bankruptcy Code still allows for relief under Chapter 7 if a majority of your debts are business related. That's an easy threshold if you're in business and you know what I'm talking about. Most types of debt are eliminated and certain assets are sold off to pay back to creditors. In fact, most debtors who file Chapter 7 bankruptcy do not lose any of their property and there is no creditor distribution. This is because of many important exemptions exist in Texas that protect debtors from losing their belongings.
Chapter 7 bankruptcy is a good option for people and companies who need to relieve themselves of serious debt. It is not right for everyone, however, and you should discuss your situation with an experienced bankruptcy lawyer before you choose this option.
